The «28 Day Sober Challenge» CONTEST

 

Official rules

 

1. CONTEST DURATION

The « 28 Day Sober Challenge » Contest (the « Contest ») is organized by the Fondation Jean Lapointe, (the « Organizer ») and starts February 1, 2018, 12:00 a.m. (Eastern Daylight Time) and ends February 28th, 2018, 11:59 p.m. (Eastern Daylight Time).

 

2. ELIGIBILITY

The Contest is open to legal residents who have reached the legal age of majority in their respective country at the Contest opening date. Employees of the Fondation Jean Lapointe, their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Contest. For the purpose of these Contest rules, “immediate family” means husband, wife, spouse, common law spouse, mother, father, grandmother, grandfather, brother, sister, son and/or daughter, whether or not they reside in the same household.

 

3. HOW TO PARTICIPATE

To participate, the entrant must visit the Internet site https://www.defi28jours.com (the « Contest Web site») and complete the official online entry form, donate at least $28 to the Fondation Jean Lapointe and fulfill all Contest requirements, as specified, to be eligible to win a prize. All data fields on the entry form must be completed, unless it is indicated that the information is optional. Only Contest participants are entitled to prizes, if they indicate they have not consumed alcohol during a given period. A participant in the Contest may submit only one (1) entry form during the Contest period. A participant in the Contest can only use one (1) email address (which must be valid) to register on the Contest Web site. One (1) participant per entry form. One (1) email address cannot be used by more than one (1) participant. The Organizer reserves the right to disqualify any person who violates or attempts to violate the Contest rules.

 

4. DRAWS

Draws will be held throughout the Contest period at Fondation Jean Lapointe offices located at 123 St-Pierre Street, Montreal, Quebec, H2Y 2L6. One (1) entry form will be drawn at random from all eligible entries received. The selected potential winner will be notified by telephone and email. Before being declared a winner, the selected potential winner must correctly answer a mathematical skill-testing question to be administered by email. The answer must be provided without assistance of any kind, whether mechanical or otherwise. In the event that the selected potential winner does not respond to the email from the Organizer’s representative within four (4) working days of the draw, they will be disqualified and will not receive the prize and another potential winner will be selected among all remaining eligible entrants. In the event the representative of the Organizer is unable to notify this selected potential winner within a reasonable time or if they do not respond to the email from the representative of the Organizer within four (4) working days, the selected potential winner will be disqualified and the Organizer has the right, at its sole discretion, to cancel the award.

5. PRIVACY / USE OF PERSONAL INFORMATION

By participating in the Contest, entrants consent to the collection, use and disclosure of personal information by the Organizer or its authorized agents for the purpose of administering the Contest and awarding the prizes. By accepting a prize, winners consent to any use of their name, address (city, province), voice, statements, picture, photographs or other likenesses and recordings for publicity purposes in all media and formats, including, without limitation, the Internet, without further notice or compensation, and any winner may be required to sign a document to that effect.

 

6. MISTAKES

Entry forms containing or presenting errors will be cancelled. Entry forms that have been tampered with, mutilated, altered, forged, reproduced or obtained illegally will not be eligible. Without limiting the scope of the exemption provided for in Section 5, it is understood that the beneficiaries of the exemption contained in the release form will not be liable for: a) any incomplete or inaccurate information, whether caused by the Contest website or any equipment or program used in the Contest or by any technical or human error which may occur in the processing of the entry form; b) the theft, destruction or unauthorized access to or alteration of newsletters thereof; c) technical difficulties or problems experienced with any telephone network or lines, online computer systems, servers or providers, computer equipment and software, viruses or bugs; d) the inability of the Organizer, for any reason, including congestion on the Internet or on a website, or both, to receive or send email; and e) damage to the computer system or device of the entrant or of another person due to the participation in or downloading of materials from this Contest.

 

7. RIGHT TO CANCEL, AMEND, MODIFY OR TERMINATE

By entering this Contest, each entrant agrees to be bound by these rules which are available on the Contest website throughout the Contest period.

The Organizer reserves the right, at its sole discretion, to change or cancel without notice the Contest rules, subject to obtaining any necessary approval from the Régie des alcools, des courses et des jeux. Subject to the foregoing, the Organizer can make any change at any time or terminate the Contest in whole or in part if, at its sole discretion, the Organizer determines that for any reason, the Contest is not proceeding as planned, including by reason of tampering, destruction, loss or theft of entries or any other defect that might compromise the fairness or integrity of the Contest.

 

8. MISCELLANEOUS

By entering this Contest or trying to enter, each entrant or presumed entrant agrees to release, discharge and hold harmless forever, the Organizer and its directors, officers, employees, shareholders, agents or other representatives, its parent companies and its affiliates from any claims, actions, damages, demands, manner of actions, causes of action, suits or liabilities of any nature whatsoever arising from or related to entering the Contest or attempting to enter the Contest, compliance or not to the Contest rules or the acceptance and use of the prize. Entrants who do not comply with these official rules are subject to disqualification from this Contest and any other future Contest or promotion held by the Organizer. The official Contest rules are available on the Contest website at the following address: https://www.defi28jours.com. All decisions of the Organizer and of the body responsible for judging the Contest are final and binding with respect to all aspects of the Contest. The Contest is subject to all applicable federal, provincial and municipal laws. No prize is transferable. Prizes must be accepted as awarded with no substitutions in cash or otherwise, except at the sole discretion of the Organizer. The Organizer reserves its right to substitute a prize of equal value in replacement of a prize that cannot be awarded as provided herein. The Organizer and the other releases will not be responsible for illegible, incomplete, mutilated, lost, routed to the wrong address or late entries which will be void. The use of automated systems is prohibited. Only selected entrants will be contacted. No prize will be awarded if the winner has not been confirmed. In the event of a dispute over who submitted an online entry, it will be deemed submitted by the authorized account holder of the email address submitted at the time of validation of the entry form. “Authorized account holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question. A selected entrant may be required to provide proof to the Organizer that they are the authorized account holder of the email address associated with the selected entrant.

 

The Organizer reserves its right, at its sole discretion, to disqualify from this Contest and any other Contest or any future promotion held by the Organizer, anyone guilty or suspected of having tampered with the processing of entries or the operation of the Contest or the Contest website, to have violated the official rules or acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, harass or threaten any other person.

ANY ENTRANT OR ANY OTHER PERSON WHO DELIBERATELY ATTEMPTS TO DAMAGE THE FACEBOOK PAGE OR CONTEST WEBSITE OR ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS COMMITTING AN ILLEGAL ACT AND THE ORGANIZER RESERVES, IN SUCH CASES, THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION.

9. RÉGIE DES ALCOOLS, DES COURSES ET DES JEUX

The Régie des alcools, des courses et des jeux du Québec is not related in any way to this Contest and shall not be liable in any way whatsoever for any matter relating to this Contest.

 

10. LAW

Any litigation in regards to the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation regarding the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. People who enter the Contest acknowledge having read these rules and agree to comply.
